1. Site Information
1.1. RISE Project.ro (which includes the website www.riseproject , the Rise Project mobile application, as well as the associated pages on social networks, e.g. Facebook, Instagram, Telegram, Twitter, Tik Tok) is managed by the RISE Project Association with headquarters in Bucharest, Sector 3, Calea Victoriei 21-23, et. 5, established by the decision of the District Court 3 File 438/300/2012 and registered as a legal person without patrimonial purpose by certificate no. 08/08.03.2012, Fiscal Code 30063132, e-mail: contact@riseproject, referred to throughout these terms and conditions as RISE Project.ro.
1.2. RISE Project.ro is a community of journalists, programmers and activists. We investigate organized crime and corruption affecting Romania and countries in the region. The RISE Project uncovers hidden connections between criminal organizations, politicians and businessmen – using advanced investigative techniques and intelligence analysis technologies. We obtain documents from offshore areas and analyze large volumes of information. Then we create databases and put together the puzzle that they want to hide. Source protection is essential to us.
2. Intellectual Property
2.1 The content and design of RISE Project.ro, including its look&feel and the databases accessible through it are the intellectual property of RISE Project.ro and are protected by Romanian and international legislation in force regarding copyright and rights related.
2.2 Texts posted by users – usually in the comments area – belong to them. With the publication of the comment, the user grants RISE Project.ro a free, non-exclusive and unlimited license in time and space for publication on RISE Project.ro. The copyrights on the works uploaded by the users remain with them, RISE Project.ro acting only as a free host of the respective information.
2.3. The content of RISE Project.ro can be fully reproduced in other publications only with the mention of the authors, the full source and with the written consent of RISE Project.ro obtained individually via an email to contact@riseproroject.ro . Any partial reproduction (within the limit of 1000 characters) is allowed without our explicit consent, if the mention of the authors and the full source are kept (active link to the article on riseproject).
2.4. Except for the cases in 2.3 and 2.4, you can use the content of RISE Project.ro only for your personal use, and any other actions and in particular those described below are not allowed without obtaining a prior written permission from RISE Project .ro:
- a. removing the signs that identify the copyright of RISE Project.ro on the content;
- b. modifying, publishing, transmitting, retransmitting in any way or form, as well as participating in the transfer, sale, distribution of materials made by reproducing, modifying or displaying the content, without obtaining prior written permission from us;
- c. reproducing or storing the content, as well as sending this content to any other website, server or any other means of information storage, if the purpose of this activity is a commercial one.
2.5. In the case of works uploaded by users, RISE Project.ro operates in a free hosting regime and as such we cannot be held responsible for the content placed by third parties on our server. Due to the large number of hosted files, it is impossible to make an individual and objective assessment of each content posted by registered users. Although we make every effort to identify and delete content that would violate the intellectual property rights of other people, the purpose of the RISE Project.ro site being to inform our readers in a legal manner, there is a possibility that certain content posted by registered users may violate the rights of third parties . Under these conditions, please send us an e-mail to the address contact@riseproroject.ro, with the infringed rights, to allow the administrators of RISE Project.ro to act in accordance with the legal provisions according to art. 14 of Law 365/2002 on electronic commerce.
2.6 RISE Project.ro users understand that they are responsible for any content published by them on the platform provided by riseproject and that they are the only ones who can be held responsible by the competent authorities for the violation of any regulatory act, regardless of whether we are talking about published comments or any other type of content.
2.7. RISE Project.ro is a registered trademark on 12.01.2017, no. 149748. It is forbidden to use it in any way, without written consent from RISE Project.ro.
3. Approval of comments
3.1. RISE Project.ro reserves the right not to approve or disable (without the subsequent possibility for users to reactivate) those information or comments submitted for publication or published that contravene the terms and conditions of use, which are outside the subject of the main article or that they consider, unilaterally, to be illegal, discriminatory, insulting, inappropriate or harmful, in any way, to their own image, partners or third parties.
3.2. The user is solely responsible for the content of messages submitted for publication.
3.3. The user must also understand that he cannot publish, transmit or refer to the users or members of RISE Project.ro any kind of unsolicited commercial message, messages with confidential information, messages containing viruses or any other code sequences that prove to be destructive or that may interrupt, eliminate or limit the functionality of RISE Project.ro, “pyramid game” type messages or any other activity intended to deceive the trust of other people as well as any messages containing illegal, immoral, abusive, threatening, abusive texts , indecent, that infringes in any way the right of intellectual property or other rights that a third party may have.
4. Report alleged illegal content
If you believe that certain content on the RISE Project.ro website violates your intellectual property rights, the right to privacy, publicity or other personal rights, please send an e-mail to contact@riseproroject .ro with the infringed rights, to allow the administrators of RISE Project.ro to act in accordance with the legal provisions according to Law 365/2002 on electronic commerce.
5. Access or modification of the site
5.1. RISE Project.ro may, without any other notification or formality and without this requiring an explanation of its attitude, suspend or block your access to the content of the website, the application or a part of this content.
5.2. RISE Project.ro reserves the right to suspend, modify, add or delete portions of its content at any time. Also, RISE Project.ro reserves the right to restrict users’ access to part or all of its content.
6. Advertising and Content Provided by Other Parties
6.1. There is no advertising content or advertising messages for third parties on the riseproject website. The RISE Project is funded by donations from readers, companies and grants. Our main financiers over time have been: Open Society Foundation, US Department of State – United States Embassy in Romania, Journalism Development Network Inc. / OCCRP, National Endowment for Democracy, Swiss-Romanian Cooperation Program, International Press Institute, Active Citizens Fund Romania. 6.2. RISE Project.ro is not responsible for the content of external pages to which reference is made from within it.
7. Processing of personal data
Personal data are processed according to the Personal Data Policy available at this link – https://www.riseproject.ro/privacy-policy/
8. Modification of these Terms and Conditions
RISE Project.ro reserves the right to change these terms, modifying the version and date of adoption of the new Terms, without the fulfillment of other formalities. When these terms change, RISE Project.ro will notify by publishing on the first page of the website or application, a link that refers to the new form of this document.
9. Governing Law
The rights and obligations of the parties, imposed by these terms and conditions, as well as all the legal effects that this agreement produces, will be interpreted and governed by the Romanian law in force. Any dispute that is the object of this agreement will be brought for resolution before an arbitrator, and in the conditions that the parties do not agree on the appointment of an arbitrator within 15 days from the notification of the dispute, the competence will return to the Romanian courts at the headquarters RISE Project.ro.
